Wills

A professionally prepared Will gives you control over what happens to your estate when you die. Without a valid Will, the law decides who inherits your assets, which may not reflect your wishes.At Newquay Wills & Estates, we take the time to understand your circumstances and ensure your Will is tailored to your needs.

Mirror Wills

Mirror Wills are two separate Wills containing similar instructions, often used by married couples or long-term partners. They are a popular solution where both individuals wish to leave their estate to each other on first death and then to children or other beneficiaries on second death.

Lasting Powers of Attorney

A Lasting Power of Attorney (LPA) allows you to appoint trusted people to make decisions on your behalf if you become unable to make decisions for yourself. Many people assume their spouse, partner or children can automatically step in. Unfortunately, this is not the case. Without an LPA, your loved ones may need to apply to the Court of Protection, which can be costly, stressful and time-consuming.

Sit down with us

Get in touch and we'll arrange a no-obligation chat at a time that suits you. Ahead of your appointment we'll send over a short list of things worth thinking about; who you'd like as executors, any specific gifts or legacies, and guardians for children where that applies. 

At your first face-to-face meeting we'll take the time to properly understand your circumstances and what you want to achieve. We'll talk through the options and help shape a package that fits your situation in the most effective way. Once we've agreed the objectives, we'll go away and draft your will.

Review your draft

We'll send you the draft to look over, along with a plain-English explanation of what each clause actually means, no legal jargon left unexplained. This version is clearly marked "draft" so there's no mixing it up with the final document. When you're happy and everything's confirmed, we'll produce the final bound copy, ready for signing.

Sign, check and store

Book your free initial consultation

We will arrange to meet at our Newquay office to sign (where possible), to go through the final documents and sign appropriately. Once that has been finalised, we'll check everything over to make sure it's been signed properly. A will that isn't witnessed correctly isn't valid, so this step matters! From there, we'll arrange for your will to be stored securely.

Frequently Asked Questions

  • A Will lets you decide what happens to your money, property and personal belongings after you die. It can also help you appoint guardians for children, choose who will deal with your estate and reduce uncertainty for the people you leave behind.

  • Yes. It is a good idea to review your Will after major life changes, such as getting married, divorced, having children, buying a property or receiving an inheritance. Depending on the changes needed, your Will may be updated with a codicil or replaced with a new Will.

  • Mirror Wills are two separate Wills, usually made by couples, which contain similar wishes. They commonly leave everything to the surviving partner first, then to agreed beneficiaries such as children or other family members.

  • Each person’s Will remains separate. After the first person dies, the surviving person can usually change their own Will if their circumstances or wishes change. If you want greater protection over who ultimately inherits, a Trust may be worth considering.

  • A Lasting Power of Attorney, often called an LPA, is a legal document that allows you to appoint trusted people to make decisions on your behalf if you are unable to make them yourself or no longer wish to do so.

  • There are two types of LPA: a Property and Financial Affairs LPA, which covers decisions about money, bills and property; and a Health and Welfare LPA, which covers decisions about care, medical treatment and living arrangements.

  • A Trust is a legal arrangement that allows assets to be held and managed by trustees for the benefit of chosen people, known as beneficiaries. Trusts can be used to protect assets, provide for children or vulnerable beneficiaries, and control how and when money is passed on.

  • A Trust is not right for everyone, but it can be useful where you want to protect assets for children, provide for someone who may need support, or give a partner the right to benefit from an asset while preserving it for other beneficiaries in the future.
